Terms and Conditions

Article 1 - Definitions


In these terms and conditions, the following definitions apply:

• Consumer: a person who purchases goods for personal use and not for resale or commercial purposes.
• Business Days: Monday to Friday, excluding public holidays in Australia.
• Major Failure: as defined under the Australian Consumer Law, where a product is substantially unfit for purpose, unsafe, or differs significantly from its description or sample.
• ACL: Australian Consumer Law as contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth).

Article 3 - Applicability


These terms and conditions apply to all offers, sales, and supplies of goods by the business to consumers in Australia.
By purchasing from our website, the consumer accepts these terms and conditions.

Article 4 - The Offer


We strive to ensure that product descriptions, images, and details are accurate. However, minor variations in colour or sizing may occur.
Obvious errors or misprints are not binding. Prices are displayed in AUD and include GST unless otherwise stated.

Article 5 - The Contract


The contract is formed when the consumer places an order and payment is received. An order confirmation will be sent by email.
All contracts are subject to product availability. If a product is unavailable, we will contact you to arrange a refund or replacement.

Article 6 - Consumer Guarantees under ACL


Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage.
You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Article 7 - Returns and Refunds


We do not offer refunds or exchanges for change of mind purchases unless we choose to do so voluntarily.
If the product is faulty, unsafe, misdescribed, or does not meet ACL guarantees, you may return it at no cost to you.
For hygiene reasons, certain items such as underwear and socks cannot be returned for change of mind. This does not affect your ACL rights if the item is faulty.

Article 8 - Prices and Payment


All prices are in Australian dollars (AUD) and include GST where applicable. Payment must be made at the time of purchase.
We accept payments through secure methods as indicated on the website.

Article 9 - Delivery


Orders are shipped within Australia and internationally where specified. Delivery times vary, but we aim to deliver within 5–12 business days unless otherwise stated.
Risk of loss or damage passes to the consumer upon delivery.

Article 10 - Complaints


If you have a complaint, please contact our customer service at info@charlieandted.com. We aim to respond within 14 days.

Article 11 - Governing Law


These Terms are governed by the laws of Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Australia.
